County Charter Amendment Process Overview

 

1. Petition form must be approved by SOE (form requirements outlined in Clay County Code - Article 1, Section 2.9).
2. Title to be included. Must not exceed 15 words (Clay County Code - Article 1, Section 2.9).
3. Summary must not exceed 75 words (Clay County Code - Article 1, Section 2.9).
4. Must include “Pd. Pol. Ad” disclaimer which meets all requirements outlined in F.S. 106.143.
5. Petitioner needs signatures from 10% of the registered voters who cast a ballot in the last General Election (County Charter 4.2.A (1)).
6. Petitioner is charged at time of submission and 10 cents per signature is collected (County Charter 4.2.A (3)).
7. Signatures must be collected within 180 days from SOE approval noted in step (County Charter 4.2.A (3)). Note: This time frame may need to be collapsed in order to meet time requirements for other steps in this process to ensure full process completion by election date.
8. SOE has 60 days to verify signatures (County Charter 4.2.A (3)).
9. When petition certification has been verified BCC must be notified in writing.
10. Amendment proposed by petition shall be placed on the ballot by resolution of the Board of County Commissioners for the general election occurring in excess of ninety (90) days from the certification.
11. The ordinance becomes law if approved by the majority (60%) of voters who cast a vote on the issue in that election, if not specified in the ordinance, on January 1 of the succeeding year (County Charter 4.2.A (4)).
